What We Collect
When you create an account or use WaiverFlow, we collect information necessary to deliver the service. This falls into a few categories:
- Account information: your name, email address, and company name when you register.
- Waiver data: the details you enter when creating or requesting a waiver — project name, contract amounts, through dates, state, and the names of signers and payees.
- E-signature records: when a waiver is signed through WaiverFlow, we capture the signer's typed name, IP address, timestamp, and the fact that they checked an explicit consent checkbox. This data is part of the legal record for that waiver.
- Payment information: if you subscribe to the Request plan, your billing details are collected at checkout. We do not store your full credit card number on our servers.
- Usage data: basic information about how you use the app — pages visited, features used, and error events — to help us improve the product. We do not sell this data or use it for advertising.
How We Use It
We use the information we collect to:
- Deliver the WaiverFlow service — create, send, sign, and store your lien waivers.
- Send waiver request emails and reminder notifications to signers on your behalf.
- Generate signed PDF records that include the complete audit trail.
- Process your subscription and manage billing.
- Improve the product — fix bugs, understand what features matter, and prioritize what to build next.
- Communicate with you about your account, including receipts, service updates, and responses to support requests.
We do not use your data for advertising. We do not sell your data. We do not build profiles on your signers beyond what is needed for the legal record.
Data Storage & Security
Your waiver documents are stored on our dedicated private servers. All data in transit between your browser and our servers travels over HTTPS. Every action taken on a waiver — creation, sending, signing, downloading — is recorded in an audit trail.
We take data security seriously, but no system is perfectly invulnerable. If we become aware of a breach affecting your data, we will notify you promptly. We do not sell your data to third parties under any circumstances.
Sharing
We share your data only with the service providers necessary to deliver WaiverFlow:
- Email delivery providers — used to send waiver request links and reminder emails to your signers.
We do not sell your data to data brokers, advertisers, or any third party. We may disclose your data if required by law, court order, or to protect WaiverFlow's legal rights — but we will not do so beyond what is legally required.
E-Signature Records
WaiverFlow's e-signature process captures the following at the moment of signing: the signer's typed full name, their IP address, the date and time of signing (UTC), and confirmation that the signer checked an explicit consent checkbox acknowledging the legal nature of the document.
This data is embedded in the signed PDF and stored as part of the waiver record. It is not used for any purpose other than maintaining the integrity of the legal record. This data is retained for as long as your account is active, because it is part of the document itself.
Data Retention
We retain your data for as long as your account is active. You can export all of your waiver records — including PDFs and audit trails — at any time from your dashboard.
If you delete your account, we will purge your data from our systems within 30 days, except where we are legally required to retain it (for example, to satisfy a tax or legal obligation). Waiver records that have been shared with third parties (such as a GC who received a signed waiver) remain with that party after your account is deleted.
Your Rights
You have the right to access, correct, export, or delete the data WaiverFlow holds about you. To exercise any of these rights, email us at mike@waiverflow.io. We will respond within a reasonable timeframe.
If you are in a jurisdiction with specific data rights (such as the CCPA in California or GDPR in the EU), you may have additional rights. Email us and we will work with you to address your request.
Cookies
WaiverFlow uses session cookies to keep you logged in while you use the app. We do not use tracking cookies, advertising cookies, or any third-party cookies that follow you around the web. When you close your session, session cookies are cleared.
We do not use any third-party analytics or advertising pixels on our marketing site or in the application.
